Excel Care

UNISON members employed by Excelcare have won a major settlement of their claims worth nearly £1m overall.

UNISON and GMB took cases against Excelcare after care home staff, had been asked to accept pay cuts of 40%

115 UNISON and GMB members who had been TUPE transferred to ExcelCare after Essex County privatised their care homes, took the cases after Excelcare sought to cut their pay by 40% in breach of the transfer of Undertakings Regulations that are supposed to ensure pay is protected.

Settlements range in value for individuals from £1000 to over £30000.

Denise Yapp who was a steward at Goldenley Healthcare in Benfleet…one the Excelcare homes said “ the staff I have talked to are thrilled with UNISON’s input and are very grateful for all the work Michelle Bradley put into the claim.  We are a little disappointed that we were unable to rebuke Excelcare in tribunal, but happy that the settlement indicated that they knew they were wrong.”

Ann Vinden Regional Manager for Local Government at UNISON Eastern said:  “I am delighted that our members have at last had their claims settled.  This case has been running for over 4 years and  thanks to the hard work and tenacity of Regional Organiser,  Michelle Bradley, and stewards with Thompsons solicitors this case has now been settled.”
